Your Rights and Responsibilities

Your rights as a worker are based on and guaranteed by what is known as the General Duty Clause.  This clause is part of the law passed by Congress in 1970 known as the Occupational Health and Safety Act, more commonly referred to as OSHA. The General Duty Clause states the following:

SEC.5. Duties

 

  • Each employer:

     

  1. Shall furnish to each of his employees, employment and places of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

   2. Shall comply with occupational safety and health standards promulgated under this Act.

 

 

  • Each employee:

 

   1. Shall comply with occupational safety and health standards and all rules, regulations, and orders

       issued pursuant to this Act which are applicable to his own actions and conduct.

In short both the employer and the employee have responsibilities to ensure a safe as well as a productive work place.

We ask our workers to help us to maintain a safe work environment, and we encourage feedback about conditions or situations that may need correction.  It is always your right to contact OSHA directly if a problem is not addressed in a timely manner by Fred Shearer and Sons.
